We are not solicitors, barristers, or legal practitioners. We are not registered with any Australian legal services board or regulatory body. No solicitor-client or attorney-client relationship is created by your use of this service.

1. About the Service
FineAppeal.com.au ("the Service", "we", "us", "our") is an online tool that generates fine appeal letters for use in Australian states and territories. The Service covers parking fines, toll road fines, traffic fines, and other government-issued infringement notices. It provides a guided process to help users identify potential grounds for appeal based on publicly available information about fine legislation and government appeal processes.
The letters generated by the Service are based on general publicly available information. They are not tailored legal documents and do not take into account the full legal complexity of any individual case. We do not submit appeals on your behalf. You are responsible for submitting the generated letter to the relevant authority.
Letters are generated based on publicly available legislation, government guidelines, and appeal processes current at the time of generation. Laws and processes change \u2014 always verify submission requirements with the issuing authority.
2. No Guarantee of Outcome
We make no representation, warranty, or guarantee that using a letter generated by the Service will result in your fine being withdrawn, reduced, or otherwise varied. The outcome of any appeal or review is determined solely by the relevant authority (council, state revenue office, or court) based on the individual facts and circumstances of your case.
The "appeal chance" assessment provided during the process (high, medium, or low) is an indicative estimate only, based on general patterns. It is not a prediction of the outcome of your specific appeal.
3. Eligibility and Use
The Service is intended for use by individuals who have received a fine or infringement notice in Australia and wish to generate an appeal letter. By using the Service, you confirm that:
- You are at least 18 years of age.
- The information you provide during the appeal process is accurate and truthful to the best of your knowledge.
- You understand that the letter generated is not legal advice.
- You are responsible for reviewing the letter before submitting it and for ensuring its contents are accurate.
4. Payment and Refund Policy
The Service costs $9.99 AUD per appeal letter. Payment is collected via Stripe immediately before the letter is generated and made available for download.
No refunds are available once a letter has been generated and made available for download. This is because the letter is a digital product that is delivered instantly upon payment. You have the opportunity to review your assessment and appeal chance estimate before making payment.
If you experience a technical issue that prevents you from downloading your letter after payment, please contact us at the address below and we will ensure you receive your letter.
5. Data Handling and Privacy
We take your privacy seriously. Here is how we handle your data:
- We do not collect, store, or transmit your personal details (name, address, phone, email, penalty notice number, vehicle registration). These details are entered by you directly into the letter in your browser and are never sent to our servers.
- We do not create user accounts. There is no sign-up, login, or stored profile associated with the Service.
- Payment information is processed securely by Stripe. We do not see, store, or have access to your full credit card number.
- Anonymous usage data (such as which states and offence types are most commonly selected) may be retained for the purpose of improving the Service. This data is not linked to any individual user.
- We do not sell, share, or provide your personal data to any third party, except as required by law.
6. Accuracy of Information
We make reasonable efforts to keep our database of fine legislation, penalty amounts, appeal grounds, and government processes accurate and up to date. However, laws and processes change frequently, and we cannot guarantee that all information is current at the time you use the Service.
It is your responsibility to verify the accuracy of any information provided, including fine amounts, appeal deadlines, submission addresses, and legislative references, before submitting your appeal. If in doubt, contact the relevant council or state authority directly.
7. Limitation of Liability
To the maximum extent permitted by law, FineAppeal.com.au, its owners, operators, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to:
- The rejection of your fine appeal.
- Any escalation of your fine, late fees, enforcement action, or legal proceedings resulting from an unsuccessful appeal or reliance on the Service.
- Any inaccuracy in the legislative references, fine amounts, deadlines, or appeal processes contained in the Service or generated letters.
- Any loss of time, inconvenience, or other consequential loss.
Our maximum liability to you in respect of the Service is limited to the amount you paid for the specific letter in question ($9.99 AUD).
8. Intellectual Property
The content, design, and code of the Service (excluding the personal information you provide) are owned by FineAppeal.com.au. You are granted a limited, personal, non-transferable licence to use any letter generated by the Service for the sole purpose of submitting a fine appeal. You may not redistribute, resell, or commercially exploit the letters or the Service.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising out of or in connection with these Terms or the Service.
10. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) or any equivalent state or territory legislation that cannot be lawfully excluded, restricted, or modified. If any provision of these Terms is found to be void, unenforceable, or contrary to law, that provision shall be read down to the extent necessary to give it validity, or if that is not possible, severed from these Terms without affecting the validity of the remaining provisions.

We reserve the right to modify these Terms of Service at any time. Changes will be effective when posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
